Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Frankenbiter (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms form a binding agreement between you and Frankenbiter.

2. The Service

Frankenbiter is a software plugin for DAW software that uses AI-assisted audio processing to help dialogue editors repair or reconstruct short segments of recorded speech. The plugin sends audio and text to our servers and to third-party processing infrastructure, which fulfills your request. Frankenbiter is a professional editing tool intended for use by trained audio editors in post-production workflows.

The Service is intended solely to repair, reconstruct, or restore existing recorded dialogue performances. It is not designed or authorized for use in creating new performances, substituting an actor’s original creative intent, or generating dialogue a performer did not record in the original session.

3. Accounts and Device Licensing

You must create an account to use Frankenbiter. You are responsible for maintaining the security of your account and for all activity under it.

Each account may activate the plugin on up to three (3) devices simultaneously. Device activation is managed through a pairing code system in your dashboard. You may revoke and re-activate devices at any time within this limit.

You may not share your account or license with others. Frankenbiter reserves the right to suspend accounts where abuse of the device limit is detected.

4. Credits and Purchases

Frankenbiter operates on a credit-based system. Credits are purchased in packs and deducted upon delivery of takes to your computer (one credit per take). You will not be charged for takes that fail to deliver due to a server error. Credits do not expire as long as the Service remains available. In the event Frankenbiter discontinues the Service, we will provide reasonable advance notice. Refunds for unused credits in such circumstances are not guaranteed but will be considered on a case-by-case basis.

All purchases are final. We do not offer refunds on credits once purchased, as they are a digital consumable delivered immediately upon payment. If you believe credits were incorrectly deducted, contact us at hello@frankenbiter.com and we will review on a case-by-case basis.

Prices are listed in USD and are subject to change. Changes to pricing will not affect credits already purchased.

5. Voice and Audio Content — Your Responsibility

When you submit audio to Frankenbiter, you represent and warrant that:

  • You have the legal right to use and process the audio you are submitting — including any necessary permissions from the performer, rights holder, or production.
  • Your use is limited to the repair or restoration of existing recorded dialogue. You are not using Frankenbiter to create new performances, synthesize lines a performer did not record, or substitute an actor’s original creative work without their express authorization.
  • You have obtained the informed consent of the performer whose voice is being processed — meaning they were clearly informed that their recorded voice would be processed using AI-assisted synthesis and explicitly agreed to that specific use — or you are operating under a valid written agreement — including any applicable union, guild, or collective bargaining provisions — that expressly authorizes synthetic alteration or digital replication of that performer’s voice. This includes compliance with any digital replica or AI-modification clauses contained in or required by those agreements.
  • You will not use Frankenbiter to generate audio that could be reasonably identified as any identifiable individual, whether public or private, for any purpose that person has not consented to — including deceptive, fraudulent, defamatory, or harmful uses.
  • You will not use Frankenbiter to produce content that violates any applicable law, including laws relating to defamation, fraud, harassment, or the rights of performers.

Frankenbiter is a post-production repair tool. It is intended to fix short dialogue edits within existing recordings — not to replace, impersonate, or misrepresent any individual’s voice or performance without their knowledge and consent.

You are solely responsible for ensuring your use complies with all applicable law and performer agreements — including union, guild, and collective bargaining agreements, and any applicable side letters, memoranda of agreement, or other ancillary instruments addressing synthetic voice, digital replicas, or AI-assisted voice modification. Frankenbiter accepts no liability for any claim, demand, or dispute arising from your use of audio output.

6. Prohibited Use

The following uses are not permitted:

  • Create deepfakes or synthetic audio intended to deceive or mislead.
  • Produce content designed to harass, defame, or harm any individual.
  • Circumvent or reverse-engineer the plugin, server, or licensing system.
  • Use automated scripts or tools to consume credits in bulk outside of normal plugin operation.
  • Resell, sublicense, or redistribute access to the Service.
  • Simulate dialogue, statements, or performances that the performer did not record in the original session.
  • Materially alter the emotional intent, meaning, or creative performance of a recorded line without the performer’s consent.
  • Create synthetic voice content intended for use in non-fiction contexts — including news, legal proceedings, political content, or public record — where the synthetic nature of the audio is not disclosed.

7. Intellectual Property

Frankenbiter and all associated software, branding, and documentation are the intellectual property of Frankenbiter. You are granted a limited, non-exclusive, non-transferable license to use the plugin on up to three devices for your personal or professional post-production work.

You retain all rights to audio you submit and to the rendered output you receive. Frankenbiter claims no ownership over your content.

You are the sole decision-maker for how the output you receive is used, edited, and distributed. Frankenbiter does not review, approve, or exercise editorial control over any output generated through the Service. You are the producer of the final content.

8. Data and Privacy

Audio submitted to the Service is processed and permanently deleted upon completion of your request. We do not store, log, or retain your audio. Each request is processed independently — audio submitted for one generation is never retained by or reused by Frankenbiter for any future request or purpose. Audio processing is performed through third-party service providers whose data practices are governed by their own terms and policies. We cannot control, and expressly disclaim any liability for, how those providers handle, retain, or use your audio.

9. Service Availability

Frankenbiter relies on third-party infrastructure for audio processing. We do not guarantee uninterrupted availability. We are not liable for downtime, failed renders, or service interruptions caused by our infrastructure providers or by circumstances outside our control. We will make reasonable efforts to maintain service reliability and communicate planned maintenance in advance.

10. Disclaimer and Limitation of Liability

The Service is provided “as is” without warranties of any kind. We do not warrant that the output will meet your quality requirements or be suitable for broadcast, release, or any specific professional use.

To the maximum extent permitted by law, Frankenbiter’s total liability for any claim arising from your use of the Service — including without limitation any claims relating to performer consent, union compliance, or right of publicity — is limited to the amount you paid for the credits used in the transaction giving rise to the claim. We are not liable for any indirect, incidental, or consequential damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless Frankenbiter and its officers, employees, contractors, and agents from any claim, demand, liability, loss, or expense — including reasonable legal fees — arising from: (a) your use of the Service; (b) your use or distribution of audio output; (c) any claim by a performer, rights holder, union, guild, production company, or other third party relating to your use of a voice or audio submission; or (d) your breach of these Terms. This obligation survives termination of your account.

12. Termination

We reserve the right to suspend or terminate your account if you violate these Terms, abuse the Service, or engage in conduct harmful to other users or to Frankenbiter. Unused credits will not be refunded upon termination for cause. You may close your account at any time by contacting us.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by a notice in the dashboard. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Service that cannot be resolved informally will be submitted to binding individual arbitration conducted by JAMS under its Streamlined Arbitration Rules, in Los Angeles, California. You waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.
